Indiana does not write its own SAP rules; no state does. The evaluation, the education or treatment plan, the follow-up evaluation and the observed return-to-duty test come from 49 CFR Part 40 and apply identically in every state. The state's part is the CDL itself. Since November 18, 2024 (FMCSA), the Indiana Bureau of Motor Vehicles must downgrade the license of a driver in prohibited status within 60 days, and it is the office that restores the commercial privilege after a negative return-to-duty test.

How to get your CDL back in Indiana

Losing the license and getting it back are two different processes run by two different bodies. The prohibition is federal — it lives in the FMCSA Clearinghouse and only moves when your return-to-duty steps are reported there. The license itself is Indiana’s, and Indiana Bureau of Motor Vehicles acts on what the Clearinghouse tells it. Neither one can be talked into moving early, which is why the only thing that actually shortens this is starting the evaluation sooner.

What Indiana says, in its own words

“State Driver Licensing Agencies (SDLAs) are required to remove the commercial driving privileges or deny CLP/CDL transactions for any applicant that has a status of Prohibited on DACH until FMCSA updates their status on DACH to Not Prohibited.” source
“The bureau shall not issue, renew, amend, or upgrade an applicant’s CLP or CDL unless the applicant’s status in the DACH is listed as “not prohibited”.” source
“The bureau must remove the commercial driving privileges of the CLP or CDL holder within sixty (60) days after receiving the notification from the FMCSA.” source

Note the phrase “or deny CLP/CDL transactions.” In Indiana a prohibited status does not only strip the privilege you have — the rule bars the BMV from issuing, renewing, amending or upgrading the license at all while it stands, so a renewal, an upgrade, a transfer in from another state or a new CLP all stop too. Indiana also writes the federal 60-day removal window into its own administrative code rather than leaving it to the federal rule, and the BMV must query the Clearinghouse before it issues anything — so there is no version of this where the status is simply missed at the counter.

The order it has to happen in

Get evaluated by a DOT-qualified SAP. This is the only step you can start today, and every other date on this page counts from it. The SAP must meet the credential rules in 49 CFR 40.281 — a regular counselor or your family doctor cannot do it.
Finish the education or treatment the SAP prescribes. The SAP decides what and how much; nobody else can shorten it, and a second opinion from a different SAP is not permitted (§40.293).
Pass the return-to-duty test, observed, arranged through an employer or C/TPA rather than booked by you (§40.305).
The negative result is reported to the Clearinghouse and your status changes to “not prohibited.” This is the moment Indiana is waiting for — nothing you file with the state before this point moves anything.
